With regards to the incident that occurred on Pipeline Road involving a fallen tree and transformer affecting commuter sites Pipeline and Site D. Town of Greenburgh Police Records Department can provide all affected vehicle owners with an incident report. If you are interested in filing a claim you should contact the Town of Greenburgh Town Attorneys Office at (914) 989-1615. According to the Town Attorneys Office:
Anyone who has a claim for damages relating to certain alleged conduct or negligence on the part of a municipality must first file a document known as a Notice of Claim, which is required by New York State General Municipal Law Section §50-e, and must be properly served in accordance with the statute and within the statutory 90 day time frame. I have attached a copy of New York State General Municipal Law Sections §§50-e, 53 and recommend you consult with an attorney and or contact your insurance company.
The form of the notice of claim must;
(1) Be written and be sworn to in the presence of a Notary Public by or on behalf of the claimant
(the person who wishes to make a claim);
(2) Set forth the name and post office address of each claimant and his or her attorney, if any;
(3) Describe the nature of the claim;
(4) State the time when, the place where (often this needs to be very precise) and the manner in
which the claim arose;
(5) Set forth the items and damages or injuries that are claimed to have been sustained;
The Notice of Claim must be presented to the government agency, that is, ''served,'' by (i) personal delivery, or (ii) registered or certified mail. The service must be made upon our Town Clerk’s Office, or in the alternative, service upon the New York Secretary of State as an agent, designated by law for service.
Anyone involved in this incident, whose car being damaged has subsequently damaged their parking permit and/or made their security access card inaccessible, should visit the parking office for a replacement at no charge. Our office is located in the Site A garage on Level 3 and is open M-TH from 7AM-4PM, F from 7AM-3PM.
